These Terms of Service ("Terms") apply to your use of this website and any purchase from Marceau XV ("we," "us," "our"). By using this website or placing an order, you agree to these Terms, our Refund Policy, our Shipping Policy, and our Privacy Policy. If you do not agree, do not use this website or place an order.

1. Eligibility

You must be at least 18 years old, or have permission from a parent or guardian, to place an order.

2. Our products

Marceau XV fragrances are original compositions inspired by the scent profiles of well-known fragrances. They are not the original products, are not made or sold by the owners of those brands, and are not guaranteed to smell identical to them. Marceau XV is an independent brand and is not affiliated with, associated with, or endorsed by any brand or trademark owner mentioned on this website. All trademarks belong to their respective owners and are used only to describe the general scent profile.

Scent perception, longevity, and projection vary from person to person. Small visible particles in the liquid and slight color differences between batches are a normal result of our compounding process. Product photos are for illustration and may differ slightly from the product you receive.

3. Safe use

Our products are for external use only. Fragrance is flammable: keep it away from heat and open flame. Keep it out of reach of children and pets, and avoid contact with eyes. If irritation occurs, stop using the product. Do a patch test before full use, especially if you have sensitive skin or allergies. You use the products at your own risk, and Marceau XV is not responsible for allergic reactions, skin irritation, or misuse.

4. Orders and pricing

All prices are in U.S. dollars. Prices, products, and promotions may change at any time without notice. Bundle pricing, such as "any two for $84.99," applies automatically at checkout and cannot be combined with other offers unless stated. We reserve the right to refuse, limit, or cancel any order, including for suspected fraud, resale, pricing or listing errors, or unavailable stock. If we cancel a paid order, we will refund you in full.

Orders cannot be cancelled or changed by the customer after they are placed.

5. Payment

By placing an order, you confirm that you are authorized to use the payment method you provide. Payments are processed through Shopify's checkout. We do not store your full card details.

6. Shipping and risk of loss

We ship only within the contiguous United States. Title and risk of loss pass to you when we hand your order to the carrier. Delivery estimates are not guaranteed. Full details are in our Shipping Policy.

7. All sales final

All sales are final. We do not accept returns or exchanges. The only exception is a bottle that arrives broken and is reported according to our Refund Policy.

8. Disputes and chargebacks

Please contact us first about any problem with your order so we can try to resolve it. If you file a payment dispute or chargeback, we may share your order details, communications, shipping and tracking records, and these Terms with the payment processor in response.

9. Disclaimer of warranties

To the fullest extent permitted by law, our products and this website are provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability or fitness for a particular purpose.

10. Limitation of liability

To the fullest extent permitted by law, Marceau XV and its owner will not be liable for any indirect, incidental, special, or consequential damages arising from your use of this website or our products. Our total liability for any claim related to an order is limited to the amount you paid for that order.

11. Indemnification

You agree to hold Marceau XV harmless from any claims, losses, or costs arising from your misuse of our products, your violation of these Terms, or your violation of any law.

12. Website content

All content on this website, including text, photos, logos, and design, belongs to Marceau XV and may not be copied or used without our written permission.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Stanislaus County, California, unless the law requires otherwise.
